What data is collected?

LW Planning collects the following data:

  1. Company contact details (company name, registered address, email, telephone number)

  2. Point of contact details (name of point of contact, direct contact number, direct email)

  3. Site details (address, planning history, planning constraints, ownership (if necessary)

  4. Planning proposal/issue.


How is data collected?

Most data is provided to us by our client(s) with exceptions around planning history and constraints which are collected directly by LW Planning from publicly available sources.

We only collect data that is necessary in order to exercise our function as planning consultant.

The lawful basis for data collection is: contract.  This means the data collected is necessary in order to fulfil the requirements of the contract between you and LW Planning.


How do we use your data?

Company/personal contact data is used to contact you to provide advice and discuss your proposals.

The planning proposal/issue and site details are used to determine that advice.


How do we store your data?

Your data is stored electronically on an encrypted laptop and backed up onto One Drive provided by Microsoft 365. This is also encrypted.  Data can also be accessed through encrypted mobile device.

When not in use these devices are locked and stored securely.

Paper records are limited to notes taken by LW Planning during site visits or meetings.  These are scanned or transcribed to an electronic record.


How long do we keep your data?

Your data is kept for the duration of the project.  Once the project is completed it is kept for a further 12 months at which point it is deleted.  

If, at any point, LW Planning is no longer involved in the project, the data is kept for 12 months before being deleted.

Electronic data is deleted from both local storage on the encrypted devices and the cloud storage (One Drive) before being permanently deleted from ‘trash’ or ‘recycle bin’.

Paper records are destroyed as soon as the are no longer required and, in any event, in line with electronic records.


Your data protection rights

LW Planning would like to make sure you are fully aware of your data protection rights.  Every user is entitled to the following:

The right to access â€“ you have the right to request copies of your personal data

The right to rectification â€“ you have he right to request correction of any information you believe is inaccurate.  You also have the right to request the completion of incomplete data.

The right to erasure – you have the right to request erasure of your personal data, under certain conditions.

The right to restrict processing â€“ you have the right to request the restriction of processing of your personal data, under certain conditions.

The right to object to processing – you have the right to object to the processing of your personal data, under certain conditions.

The right to data portability â€“ you have the right to request that you data is transferred to another organisation or directly to you, under certain conditions.

Data sharing

We only share data with outside authorities where it is necessary to do so and we have your permission to do so.  Prior to sharing data we will confirm the data we intend to share for approval.

A typical example would be details of the site with the local planning authority in order to arrange a pre-application meeting or submission of a planning application.

Data breaches

If we become aware of any breach or suspect a breach we will take the following action:

  1. We will notify you of the nature and extent of the breach

  2. We will inform the ICO of any breach, within 72 hours, if it meets the relevant criteria

  3. We will investigate the breach and take steps to prevent future breaches.


Cookies

Cookies are text files placed on your computer to collect standard Internet log information and visitor behaviour information.  When you visit our website, we may collect information from you through cookies or similar technology.  For further information, visit allaboutcookies.org
